Terms of Service

These Terms of Service govern your use of this website and any purchase you make from OffroadGearPro(“we,” “us,” “our”). By using the site or placing an order, you agree to these terms. If you do not agree, do not use the site.
Please read sections 10 through 15 carefully. They cover off-road use, assumption of risk, recovery equipment, warranty disclaimers, and limits on our liability. Off-road riding is inherently dangerous, and the products we sell do not make it safe.
1. Eligibility
You must be at least 18 years old, or the age of majority where you live, to place an order. If you are younger, a parent or legal guardian must place the order and accept these terms on your behalf. By ordering you represent that you have the legal capacity to enter this agreement.
2. Your Account
You are responsible for keeping your account credentials confidential and for all activity under your account. Tell us promptly if you believe your account has been compromised. You agree to provide accurate information and to keep your shipping and contact details current — we are not responsible for a delivery that fails because the address you gave us was wrong.
3. Product Information and Errors
We work to describe products, specifications, fitment, and pricing accurately, but we do not warrant that every listing is error-free. Product images are representative; finishes, hardware, and packaging may differ. Manufacturers change specifications without notice.
If a product is listed at an incorrect price or with a materially incorrect description, we may cancel the order even after you receive a confirmation. If we cancel for that reason and you have already been charged, we will refund you in full.
4. Orders and Acceptance
Your order is an offer to buy. An order confirmation email acknowledges that we received it — it is not acceptance. We accept your offer when we ship the product. Until then we may decline or cancel an order for any lawful reason, including suspected fraud, pricing errors, quantity limits, or stock we cannot source.
5. Pricing, Taxes, and Fees
Prices are in US dollars and exclude shipping and tax unless stated otherwise. Sales tax is calculated at checkout based on your shipping destination. Freight surcharges on oversized items are calculated and shown at checkout before you pay. International orders may incur duties and import taxes, which are your responsibility and are not collected by us.
6. Payment
Payment is processed by a third-party payment processor. By submitting payment information you authorize us and our processor to charge your selected payment method for the full order total. You represent that you are authorized to use the payment method. We do not store full card numbers — see our Privacy Policy.
7. Shipping and Delivery
Delivery estimates are estimates, not guarantees. We are not liable for carrier delays, weather, or events outside our control. Freight shipments are curbside only and require someone present to receive them. Full details are in our Shipping Policy.
8. Title and Risk of Loss
Title and risk of loss pass to you upon delivery. If a shipment arrives damaged or does not arrive, contact us and we will replace it or refund you, and we will handle the carrier claim. For freight deliveries you must note visible damage on the delivery receipt before signing — without that notation the carrier will usually deny the claim, and we may not be able to cover the loss.
9. Returns
Returns are governed by our Returns & Refunds Policy, which is incorporated into these terms. In short: 30 days, uninstalled, original packaging. Mounted tires, installed armor, spliced wiring, and impacted helmets cannot be returned.
10. Off-Road Use Only
Products sold here are intended for off-road, recreational use on ATVs and UTVs. Unless a product listing expressly states otherwise, assume the product is not approved or legal for use on public roads. Beadlock wheels and auxiliary lighting in particular are generally off-road use only.
Laws governing off-highway vehicles — road legality, registration, lighting, sound limits, helmet requirements, and where you may ride — vary by state, county, and land management agency. You are solely responsible for knowing and complying with the rules that apply where you ride. Nothing on this site is a representation that a product is legal for your intended use.
11. Assumption of Risk
Operating an ATV or UTV is inherently dangerous and can result in serious injury, permanent disability, or death. Accessories, protective equipment, and armor reduce some risks; they do not eliminate them, and they may introduce new ones. Larger tires, added weight, lifts, and modified suspension can change how a machine handles, brakes, and resists rollover.
By purchasing from us you acknowledge these risks and accept them voluntarily. You are responsible for wearing appropriate protective gear, operating within your ability and your machine's limits, and following the vehicle manufacturer's operating instructions.
12. Recovery Equipment
Winches, ropes, straps, shackles, and related rigging operate under extreme loads and can fail catastrophically. A failure can launch components at lethal speed. You agree that you will:
- Never exceed the manufacturer's rated working load for any component
- Never use a tow ball, hitch pin, or cargo tie-down point as a recovery anchor
- Inspect all equipment before each use and retire anything damaged, frayed, or deformed
- Keep all people clear of a loaded line by at least the full length of that line
- Follow the manufacturer's instructions and recognized recovery practice
Rated capacities describe equipment tested under controlled conditions. They are not a promise of performance in the field, where shock loading, angles, wear, and anchor quality all reduce effective strength.
13. Fitment and Installation
Fitment information is provided in good faith and, where we can, we will confirm it for your specific year, make, and model before you order. You remain responsible for verifying that a product suits your machine and your intended use.
Installation is your responsibility. We strongly recommend professional installation for suspension, steering, braking, drivetrain, and electrical components. We are not liable for damage, injury, or loss resulting from incorrect installation, improper torque, unsuitable modification, or use of a product outside its intended purpose.
Modifications may void your vehicle manufacturer's warranty. Oversized tires that accelerate belt or clutch wear are a common example. Check with your dealer before installing if that concerns you.
14. Warranties
Products may carry a warranty from their manufacturer. Where a manufacturer warranty exists, we pass it through to you and will help you file a claim, but the manufacturer — not us — determines the outcome. Manufacturer warranties typically exclude normal wear, impact damage, racing or competition use, and failures caused by improper installation.
Except for the express manufacturer warranties described above, and to the fullest extent permitted by law, products are provided “as is” and we disclaim all other warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you. Nothing here limits rights you have under mandatory consumer protection law.
15. Limitation of Liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, loss of use, vehicle damage, or the cost of substitute goods, arising out of or related to your use of this site or any product purchased from us — even if we were advised of the possibility.
Our total aggregate liability arising out of or related to any product or order will not exceed the greater of the amount you actually paid for the product at issue or one hundred US dollars.
Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable law. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
16. Indemnification
You agree to indemnify and hold harmless OffroadGearPro and its officers, employees, and suppliers from any claim, loss, liability, or expense, including reasonable legal fees, arising from your violation of these terms, your misuse of a product, your installation of a product, or your operation of a vehicle in violation of applicable law.
17. Governing Law and Disputes
These terms are governed by the laws of the State of Washington, without regard to its conflict of laws rules. The UN Convention on Contracts for the International Sale of Goods does not apply.
Talk to us first. If you have a dispute, email support@offroadgearpro.com with a description of the problem and the resolution you want. We will try in good faith to resolve it informally within 30 days. Most problems end here.
If we cannot resolve it, any action must be brought in the state or federal courts located in Clark County, Washington, and you and we consent to the personal jurisdiction of those courts. This does not prevent either of us from seeking relief in small claims court where the claim qualifies.
18. Acceptable Use
You agree not to use this site to violate any law, infringe anyone's rights, or interfere with its operation. That includes scraping, automated data collection without our written permission, attempting to gain unauthorized access, submitting false orders, and reselling products in a way that misrepresents their origin or specifications.
19. Intellectual Property
The site and its content — text, product descriptions, photography, layout, and logos — are owned by us or our licensors and protected by intellectual property laws. You may not reproduce, distribute, or create derivative works from it without our written permission. Manufacturer names and marks are the property of their respective owners and are used only to identify products.
20. Content You Submit
If you submit a review, photo, question, or other content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and reproduce it in connection with our business. You represent that you own the content or have the right to share it. We may remove content that is unlawful, misleading, or off-topic, and we may decline to publish safety advice we believe is dangerous.
21. Third-Party Services
We rely on third parties for payments, authentication, hosting, and shipping. Your use of those services may also be subject to their own terms. We are not responsible for the acts or omissions of third parties beyond our reasonable control.
22. Changes to These Terms
We may update these terms from time to time. We will revise the “last updated” date above, and material changes take effect for orders placed after the change. The terms that applied when you placed an order govern that order.
23. General
If any provision of these terms is held unenforceable, the rest remains in effect and the unenforceable provision will be limited to the minimum extent necessary. Our failure to enforce a provision is not a waiver of it. You may not assign these terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. These terms, together with the policies they reference, are the entire agreement between you and us regarding your purchases.
